Fine of $22,500 and community service order of 160 hours imposed on company directors for contravening Employment Ordinance

     Two company directors of Rankine Engineering Company Limited were prosecuted by the Labour Department (LD) for violation of the requirements under the Employment Ordinance (EO). One of the directors pleaded guilty earlier at Shatin Magistrates' Courts and was fined $22,500. The other director also pleaded guilty earlier at Shatin Magistrates' Courts and was sentenced to 160 hours' community service order today (October 28). This director was also ordered to pay an outstanding sum of about $483,000 to the employees concerned.
      
     The company failed to pay 11 employees, in accordance with the EO, wages totalling around $433,000 within seven days after the date of termination of employment, and also failed to pay the awarded sum totalling around $423,000 within 14 days after the date set by the Labour Tribunal (LT). The directors concerned were prosecuted and convicted for their consent, connivance or neglect in the above offences committed by the company.
      
     "The judgment will disseminate a strong message to all employers, directors and responsible officers of companies that they have to pay wages to employees in accordance with the EO and the awarded sums according to the terms of the awards issued by the LT or the Minor Employment Claims Adjudication Board," a spokesman for the LD said.
      
     "The LD will not tolerate these offences and will spare no effort in enforcing the law and safeguarding employees' statutory rights," the spokesman added.
