******************************************************************************************
The three-day training course precisely matched with the training needs of the 70 judges from the first batch of the foreign-related adjudication talent pool from Shanghai, and invited nearly 30 core foreign-related adjudication judges from Jiangsu, Zhejiang, and Anhui to participate, building a collaborative training mechanism for foreign-related judicial talent in the Yangtze River Delta region. The training course focused on practical difficulties in foreign-related adjudication, including the characteristics of Hong Kong’s common law under the "one country, two systems" principle, its comparison and interaction with the Mainland's codified law, and practical issues such as contract law, law of evidence, judicial reviews of arbitration, ascertainment of foreign law, and drafting of judgments. The training course invited various experienced legal professionals from Hong Kong and members of the Hong Kong International Legal Talents Training Expert Committee to deliver lectures, assisting the participants in better understanding the basic framework and principles of common law and enhancing their ability to handle cross-border cases.
Mr Lam said in his video speech that under the principle of "one country, two systems", Hong Kong is the only region in the country implementing common law, and is the world's unique bilingual common law jurisdiction using both Chinese and English as official languages. He expressed the hope that the participants have gained a deeper understanding of the differences between the common law and civil law systems, strengthening exchanges and interactions on Hong Kong’s common law and Mainland laws. In his speech, Mr Jia also affirmed the benefits of the training course to the foreign-related adjudication talent from Shanghai and the Yangtze River Delta Region, and expressed his wish to continue collaboration efforts to organise such activities on a regular basis.
In addition, the Hong Kong Common Law Day, co-organised by the Training Academy and the ECUPL, was also held on November 24 at the Songjiang campus of the ECUPL. It brought together experts from universities, judicial and legal practice sectors in Hong Kong and the Mainland, sharing their views on common law and nurturing foreign-related talent with over 100 scholars and students, along with their practical experiences in handling cross-border foreign-related disputes. The participants have engaged in comprehensive dialogues from theory to practice, exploring the uniqueness of common law relief systems.
The Training Academy will continue to organise and improve its practical legal courses, inviting more experts from Hong Kong and the world, exploring diverse training models, and providing platforms for legal exchanges and training for Hong Kong, the Chinese Mainland, and countries along the Belt and Road Initiative, with a view to consolidating Hong Kong's position as a centre for international legal and dispute resolution services in the Asia-Pacific region and enabling Hong Kong to play a greater role in the country's construction of foreign-related rule of law.
