Disciplinary action against registered lift contractor and registered lift engineer

     The Disciplinary Board for the Lifts and Escalators Ordinance (the Board) has completed disciplinary hearings on the performance of Antonfield Engineering Company Limited (Antonfield), a registered lift contractor, and a registered lift engineer (RLE) of the company, and decided that the company and the RLE shall be disciplined for misconduct and neglect that contravened the relevant sections of the Lifts and Escalators Ordinance (the Ordinance). The Electrical and Mechanical Services Department welcomes the decision.

     The Board ordered Antonfield and the RLE to pay a fine of $60,000 and $5,000 respectively. They were also ordered to pay the costs and expenses incurred in the proceedings totalling $169,900.      During an inspection at Wah Lee Building, Sai Ying Pun, on May 16, 2013, the Electrical and Mechanical Services Department found that Antonfield, the lift contractor of the building, and the responsible registered lift engineer had carried out lift works without conforming to the requirement of the Ordinance, and therefore took law enforcement action. The department initiated disciplinary proceedings following completion of the prosecution.

     Antonfield committed two disciplinary offences, namely contravention of sections 3(2)(a) and 3(4) of the Lifts and Escalators (General) Regulation and failure to establish a work system to ensure that the lift works were carried out in accordance with the provisions of the Ordinance. Being appointed to carry out lift works at the aforementioned building, the RLE committed an offence of failing to issue a safety certificate after the completion of a major alteration to the lift.

     In exercising his power under section 109(1) of the Ordinance, the Director of Electrical and Mechanical Services referred the alleged disciplinary offences of Antonfield and the RLE to the Board. Appointed by the Secretary for Development, members of the Board are composed of registered professional engineers, registered persons and authorised persons nominated by professional institutions and the trade as well as laypersons representing the responsible persons of lifts and escalators.
