Contractors convicted and fined for illegally carrying out construction work at night

     A construction contractor and its sub-contractor were each fined $4,000 by Eastern Magistrates' Courts today (March 13) for illegally carrying out construction work at night, thus contravening the Noise Control Ordinance (NCO).

     A spokesman for the Environmental Protection Department (EPD) said that the department had earlier received report from a member of the public which revealed that a compactor and excavator were being used for gas pipeline replacement work on a section of Kennedy Town New Praya at around 9pm, causing noise nuisance. Based on the video and photos provided by the public, the related construction contractor and the sub-contractor were traced by the EPD. Following investigation and collection of evidence, it was confirmed that the work was carried out during restricted hours (between 7pm and 7am the next day and on a general holiday) without a valid construction noise permit (CNP). The related contractors were prosecuted for contravening the NCO.

     The spokesman reminded members of the construction sector that according to the NCO, the use of powered mechanical equipment for construction work during restricted hours is generally prohibited unless a CNP has been obtained from the EPD after a noise assessment, noise mitigation measures and other requirements stipulated in the CNP have been implemented. Members of the public are welcome to report to the EPD or the Police if any works are found being carried out during the restricted hours, with no valid CNP issued by the EPD being displayed at the construction site. EPD enforcement staff will conduct follow-up investigation and prosecute the offenders should there be sufficient evidence.

     Under the NCO, first-time offenders are liable to a maximum fine of $100,000. A maximum fine of $200,000 may be imposed on second or subsequent convictions, and a further fine of $20,000 for each day during which the offence has continued.
