Legislative Council General Election candidates should properly dispose of personal data of electors

     A spokesman for the Registration and Electoral Office (REO) said today (September 20) that the Office has earlier sent letters to candidates and their Election Agents of the 2016 Legislative Council General Election who have collected the DVD on "Candidate Mailing Label System" (CMLS) and mailing labels of electors, reminding them to destroy the DVD and any unused mailing labels, and delete any electors' information exported from the disc within two weeks after the election to prevent leakage of personal data of the electors.

     For the purpose of posting election mail, candidates may request the REO to provide a set of mailing labels and a CMLS DVD in respect of the electors of the relevant constituencies. Upon collection of the materials, the candidates or their Election Agents were requested to sign an undertaking form to the effect that information on the CMLS DVD and the mailing labels of electors must be used solely for the purpose related to the electioneering activities of the election. They also undertook to dispose of the materials properly or return them to the REO for disposal within two weeks after the election.

     The REO reminded candidates who had entrusted electors' personal data to their agents for handling or use to also ensure that their agents fully understand that the electors' personal data should only be used for purposes in relation to this election, and must arrange for proper erasure and destruction of all of the electors' personal data used or held by their agents within the above-mentioned time frame.

     According to the existing regulations, it is an offence for any person to reproduce or permit another person to reproduce in any form, use or permit another person to use, or impart to any other person, the electors' information on the above DVD and/or mailing labels for any purposes other than the purpose related to the electioneering activities of the 2016 Legislative Council General Election. Any person who commits this offence is liable to a fine of up to $5,000 and imprisonment of six months.
