Child Abduction and Custody (Parties to Convention) (Amendment) (No.2) Order 2008 to be gazetted

     The Child Abduction and Custody (Parties to Convention) (Amendment) (No.2) Order 2008 made by the Chief Executive under Section 4 of the Child Abduction and Custody Ordinance will be published in the Gazette this Friday (September 26).

     The Amendment Order adds the Republic of Costa Rica to the list of Contracting States and territories in the Schedule to the Child Abduction and Custody (Parties to Convention) Order (Cap.512 sub. leg. A), to implement the Convention on the Civil Aspects of International Child Abduction between the Hong Kong Special Administrative Region (HKSAR) and Costa Rica.  The Central People's Government accepted Costa Rica's accession to the Convention on behalf of the HKSAR in June 2008.

     A spokesman for the Labour and Welfare Bureau said that the Convention provided an effective mechanism for the swift return of children wrongfully removed from their place of habitual residence to another Contracting State in violation of custodial rights.  The Convention is now in force in 81 States.

     In accordance with the requirements of the Convention, the Amendment Order has taken effect since September 1, 2008.
