Wing Shing Building Construction Ltd and Wing Wo Aluminium & Steel Engineering Company Limited were fined $42,000 and $32,000 respectively at Tuen Mun Magistrates' Court today (July 18) for violation of Construction Sites (Safety) Regulations and the Factories and Industrial Undertakings Ordinance. The prosecutions were launched by the Labour Department.
The case involved a fatal accident which occurred on July 20, 2006, at a site in Yuen Long, in which a worker fell eight metres from a canopy to the ground.
According to Regulations 38B(1) & 38B(1A) of the Construction Sites (Safety) Regulations, the contractors shall take adequate steps to prevent a person on the site from falling from a height of two metres or more. Any contractor who fails to do so is liable to a maximum fine of $200,000 and to imprisonment for 12 months.
According to Regulations 38A(2) & 38AA(2) of the Construction Sites (Safety) Regulations, the contractor shall also ensure that safe access to and egress from place of work was provided. Any contractor who fails to do so is liable to a maximum fine of $200,000 and to imprisonment for 12 months.
