The Chairman of the Broadcasting Authority, Mr Daniel Fung, made the following statement today (June 6):
:The Broadcasting Authority has received a number of complaints against Commercial Radio in relation to the program .So Fab・. The Authority has taken on board the concerns raised by the complainants as well as those of the community at large.
:The executive arm of Broadcasting Authority, namely, the Television and Entertainment Licensing Authority, has already taken prompt action to investigate possible breaches by Commercial Radio of relevant provisions of the Radio Code of Practice on Programme Standards.
:Further, in view of the seriousness of this matter and the widespread public concerns arising therefrom, the Broadcasting Authority has taken steps to expedite the handling of this matter. In this regard, the Broadcasting Authority Complaints Committee will convene a special meeting next week with a view to making a recommendation to the full Board of the Broadcasting Authority for consideration.
:As regards observations made by certain complainants that a criminal offence may have been committed by Commercial Radio arising from the broadcasting of the programme, the setting up of a related website and the holding of an internet poll, those are questions for the Secretary for Justice rather than the Broadcasting Authority. The remit of the Broadcasting Authority as an industry regulator is confined by statute to investigating on complaint possible breaches of, in this instance, the Radio Code of Practice on Programme Standards. The Broadcasting Authority has accordingly referred all questions of possible criminal liability to the Secretary for Justice for his consideration.;
