Employer fined for breaching MPFS Ordinance

    An employer was fined $15,000 at the Kwun Tong Magistracy today (October 6), after being convicted of six offences under the Mandatory Provident Fund Schemes Ordinance.

     In today's hearing, the defendant, La Cave D'Alfred Limited trading as Alfred's Grille, was convicted on six counts of failing to make MPF contributions on time, after making deduction from the income of one employee between August 2004 and January 2005.  The defendant was fined $5,000 for the first summons, and $2,000 each for the other five summonses, totalling $15,000.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today pursued one claim in the Small Claims Tribunal for some $20,000 on behalf of one employee, who was owed MPF contributions by his employer.

     At today's hearing, Liu Chi Wah trading as Lorry Catering Service did not dispute the amount claimed.  The Adjudicator ordered it to pay the MPFA the sum of $20,160.62, being mandatory contributions in arrears and surcharges payable.

     The amount awarded will be reimbursed to the employee's MPF account as soon as it is received by the MPFA.  The court further awarded a payment of $140 as the cost of the claim.
