Company and its responsible person fined for wage offences and defaulting on payment of Labour Tribunal award

     Tat Hung Engineering Limited and its responsible person were fined $32,000 and $26,000 respectively for offences under the Employment Ordinance (EO) at the Eastern Magistrates' Courts today (July 17). The company and its responsible person were also ordered to clear an outstanding amount of about $111,000 to an employee via the court. The prosecution was launched by the Labour Department.

     The said company failed to pay wages to an employee within seven days after the expiry of wage periods and termination of employment. It also failed to pay end of year payment within seven days after the date specified in the contract of employment. Furthermore, the company failed to pay an awarded sum of about $111,000 within 14 days after the specified payment date of the Labour Tribunal award.

     The responsible person was also convicted for his consent, connivance or neglect in the wage offences and defaulting on payment of the Labour Tribunal award.

     "The judgment helps disseminate a strong message to all employers and responsible persons of companies that they have to pay wages to employees in accordance with the EO and awarded sums according to the terms of the awards issued by the Labour Tribunal or the Minor Employment Claims Adjudication Board," a spokesman for the Labour Department said.

     "The Labour Department does not tolerate the above offences and will spare no effort in enforcing the law and protecting employees' statutory rights," the spokesman added.
