Company fined for wage offence and default of Minor Employment Claims Adjudication Board awarded payment

     Companion Animal Federation Limited was fined $63,000 at Fanling Magistrates' Courts today (April 28) for offences including non-payment of wages and annual leave pay and default on awarded payment of the Minor Employment Claims Adjudication Board under the Employment Ordinance. The company was also ordered to clear the outstanding Minor Employment Claims Adjudication Board awarded sum of about $6,300 to the employee concerned via the court. The prosecution was launched by the Labour Department.

     The company failed to pay wages and annual leave pay to one employee within seven days after the termination of employment as required by the ordinance. A total payment of about $6,300 was involved. Furthermore, the company failed to pay the awarded sum of about $6,300 to the employee concerned within 14 days after the specified payment date of the Minor Employment Claims Adjudication Board award.

     "The judgment has disseminated a strong message to all employers that they have to ensure that wages and other statutory entitlements are provided to employees in accordance with the Employment Ordinance and awarded sums are paid according to the terms of the awards issued by the Labour Tribunal or the Minor Employment Claims Adjudication Board," a spokesman for the Labour Department said.

     "The Labour Department does not tolerate the above offences and will spare no effort to enforce the law in protecting employees' statutory rights," the spokesman added.
