Company and its responsible persons fined for wage offences and default of Labour Tribunal awarded payment

     DMagazine (China) Limited and its two directors were fined $40,000 and $56,000 respectively at Kwun Tong Magistrates' Courts today (March 26) for wage offences and default on awarded payment of Labour Tribunal under the Employment Ordinance. The company and its directors were also ordered to clear the outstanding Labour Tribunal awarded sums of about $115,600 to two employees via the court. The prosecution was launched by the Labour Department.

     The company failed to pay wages within seven days after the end of wage periods and to pay wages and wages in lieu of notice to one employee within seven days after the termination of employment as required by the ordinance. The total amount of payment involved was about $58,300. Furthermore, the company failed to pay the awarded sums of about $115,600 to two employees within 14 days after the specified payment date of the Labour Tribunal awards. The directors were convicted for their consent, connivance or neglect in the offences.

     "The judgment has disseminated a strong message to all companies and their responsible persons that they have to ensure that wages are paid to employees in accordance with the Employment Ordinance and awarded sums are paid according to the terms of the awards issued by the Labour Tribunal or the Minor Employment Claims Adjudication Board," a spokesman for the Labour Department said.

     "The Labour Department will not tolerate these offences and will spare no effort in bringing employers and responsible persons of companies who defy the law to justice," the spokesman added.
