Company fined for wage offences

     Smart Art International Limited was fined $300,000 at Fanling Magistrates' Courts today (October 28) for wage offences under the Employment Ordinance. The company was also ordered to clear the outstanding amount of about $33,000 to three employees via the court.

     The company failed to pay wages to three employees within seven days after the expiry of the wage period and termination of employment as required by the ordinance. The total amount of payment involved was about $82,350.

     According to the Employment Ordinance, wages due upon expiry of the last day of the wage period and the termination of the employment contract shall be paid as soon as practicable but in any case not later than seven days thereafter. Any employer who fails to do so wilfully and without reasonable excuse is liable to a maximum fine of $350,000 and imprisonment for three years.
