Lift contractor for Waterside Plaza, Tsuen Wan, prosecuted

     Prosecution has been taken out against Ben Fung Machineries & Engineering Limited, a registered lift contractor, and against a registered lift worker, for the lift incident that occurred early this year at Waterside Plaza, Tsuen Wan, a spokesman for the Electrical and Mechanical Services Department (EMSD) said today (July 25). Contraventions included failing to ensure that lift works were carried out properly and safely.

     In the early morning of January 26, 2014, lift No. 1 in Block 1, Waterside Plaza, Tsuen Wan, had a fault and the management office called the lift maintenance contractor to carry out an inspection. During the inspection, the lift was damaged after ascending too high and hitting the ceiling slab of the lift shaft. No-one was injured in the incident. After the incident, the EMSD conducted testing of the lift's safety system and found no abnormality. Evidence suggested that proper inspection and maintenance procedures were not followed and human errors were involved.

     The spokesman stressed that the department will continue to monitor closely the performance of registered lift contractors and workers and take regulatory action to ensure lift safety.

     According to the Lifts and Escalators Ordinance, registered lift contractors and registered lift workers must ensure that adequate safety precautions are taken to prevent injury to any person or damage to any property while lift works are being carried out, and that lift works are carried out properly and safely. Any registered lift contractor contravening this offence is liable to a maximum penalty of a fine of $100,000 and imprisonment for 12 months upon each conviction. A registered lift worker is liable to a maximum penalty of a fine of $10,000 for each conviction.
