Company and its director fined for wage offences and Labour Tribunal award payment default

     Golden Bauhinia Landscaping Limited and its director were fined a total of $85,000 at Fanling Magistrates' Courts today (April 1) for wage offences and defaulting on payment of Labour Tribunal award offence under the Employment Ordinance. The company director was also ordered to clear the outstanding wages via the court. The prosecution was launched by the Labour Department.

     The company failed to pay wages to four employees within seven days after the termination of employment as required by the ordinance. The total amount of payment involved was about $60,000. Furthermore, the company failed to pay the awarded sum of about $22,000 to an employee within 14 days after the specified payment date of the Labour Tribunal award. The director was convicted for his consent, connivance or neglect in the offences.

     "The judgment would send a strong message to all companies and their directors or responsible persons that they have to ensure that wages are paid to employees in accordance with the Employment Ordinance and award are paid according to the terms of the award issued by the Labour Tribunal or the Minor Employment Claims Adjudication Board," a spokesman for the Labour Department said.

     "The Labour Department will not tolerate these offences and will spare no effort in bringing to justice directors and employers who defy the law," the spokesman added.
