The following is issued on behalf of the Communications Authority:

     This press release summarises the Communications Authority (CA)'s decisions at its 21st meeting held in July 2013:

     The CA considered a complaint case against Wharf T&T Limited (WTT) for breaching section 7M of the Telecommunications Ordinance (TO) (Cap. 106). The complainant alleged that WTT's salespersons had made misleading or deceptive representations to him in relation to (a) the transmission speed of the Dedicated Internet Access Service (DIA Service) and (b) the complainant's right of early cancellation of the contracts on an unconditional basis if he was dissatisfied with the DIA Service, thereby contravening section 7M. Having considered the findings of the investigation conducted by the Office of the Communications Authority and the representations made by WTT, the CA was of the view that WTT had engaged in misleading or deceptive conduct in relation to (b) in breach of section 7M of the TO.  The CA concluded that a financial penalty of HK$80,000 to be imposed on WTT was proportionate and reasonable in relation to the breach concerned.      The CA also considered a complaint case against the radio programme "Friends Unlimited" broadcast on the Radio 1 Channel of Radio Television Hong Kong (RTHK) on March 4, 2013. The CA decided that RTHK should be strongly advised to observe more closely the relevant provision in the Radio Code of Practice on Programme Standards.
