Man sentenced for assaulting FEHD officer

     A 30-year-old man was given a suspended sentence in Tsuen Wan Magistrates' Court today (January 2) for assaulting a Food and Environmental Hygiene Department (FEHD) officer and obstructing a public officer in carrying out his duties. He was sentenced to one month's imprisonment for each of the two charges, to run concurrently and suspended for one year.

     On August 22 last year, the man refused to co-operate and assaulted the FEHD officer who arrived at the scene to assist the enforcement officer to take prosecution action against him for displaying a commercial promotional easy-mount frame at Ho Pui Street, Tsuen Wan.

     The defendant was also fined $500 for causing obstruction in a public place.

     An FEHD spokesman reminded members of the public to co-operate with law enforcement officers. According to section 139 of the Public Health and Municipal Services Ordinance (Chapter 132), any person who wilfully obstructs, resists or uses abusive language to any law enforcement officer in the execution of his duties is liable to a maximum fine of $25,000 and six months' imprisonment.

     "To use force against public officers is not right and offenders would have a criminal record when convicted. Furthermore, the FEHD would claim from the offender losses arising from the absence of duty of the injured public officers through civil litigation," he added.
