OFCA responds to continuation of broadcasting by Digital Broadcasting Corporation

     In response to media enquiries about Digital Broadcasting Corporation Hong Kong Limited (DBC), a spokesman for the Office of the Communications Authority (OFCA) gives the following response:

     "According to DBC's licence, DBC shall provide seven channels and broadcast 24 hours a day.  There is prima facie evidence that DBC's earlier cessation of service from October 10 to 14 might constitute a contravention of the above-mentioned licence condition.  As regards DBC's resumption of broadcasting on October 15, OFCA has written to DBC to seek details about the resumed service so as to ascertain whether the arrangement is in compliance with the above licence condition.  OFCA is awaiting DBC's reply.

     "The Communications Authority (CA) will process any possible contravention in accordance with the established procedures.  The range of sanctions that may be imposed by the CA against contravention includes administrative sanction (say, advice and warning), financial penalty and suspension of licence.

     "In respect of the amount of investment by DBC, its licence only contains specific condition governing the amount of investment to be incurred by the licensee from 2011 to 2017."
