The following is issued on behalf of the Communications Authority:

     This press release summarises the Communications Authority (CA)'s decisions at its 11th meeting held in October 2012:

     The CA decided on two cases in respect of telecommunications operators' compliance with the relevant licence requirements:

(a) The CA considered the findings of the investigation conducted by the Office of the Communications Authority (OFCA) into the disruption of the telecommunications services of Hutchison Telephone Company Limited (HTCL) on June 29, 2012, which had affected around 40,000 to 50,000 customers of HTCL's 3G mobile data services for around two hours. After considering the assessment of OFCA, the CA concluded that there had been no breach by HTCL of General Condition 5.1 of its Unified Carrier licence, which requires it to operate, maintain and provide a good, efficient and continuous service in a manner satisfactory to the CA. (b) On February 16, May 14 and June 4, 2012, the Director of Highways (DHy) referred to the former Office of the Telecommunications Authority and OFCA 77 cases of his determination on failure of Hong Kong Broadband Network Limited (HKBN) to comply with the minimum depth requirement (MDR) stipulated in General Condition (GC) 32(1) of its Fixed Telecommunications Network Services (FTNS) licence. After considering the assessment of OFCA, the CA concluded that HKBN had failed to comply with GC 32(1) of its FTNS licence in respect of the MDR in the 77 cases. The CA decided to issue a public warning to HKBN, in the form of a Decision, for it to comply with the MDR as determined by the DHy. The CA has further decided that, should HKBN fail to honour its undertaking to DHy and rectify any of the non-compliance cases to the satisfaction of DHy and in accordance with the timeframe as reasonably determined by DHy, the CA will issue a direction to HKBN compelling it to implement the rectification work to the satisfaction of DHy.
