Man jailed and fined for carrying passengers for reward

     A 41-year-old man was jailed for eight weeks and fined for $1 300 for offences including carrying passengers for reward at Fanling Magistrate¡¥s Court today (July 16).

     The Court heard that Police arrested a male Mainland driver, who took a vehicle to drive a Mainland pregnant woman to Hong Kong for reward at the Lok Ma Chau Control Point on May 24, 2012. He was arrested for 'driving a motor vehicle for the carriage of passengers for hire or reward', 'using a motor vehicle without third party insurance' and 'taking conveyance without authority' and subsequently charged.

     Police later examined the vehicle and found the conditions of the vehicle did not measure up to the standard. The defendant was further charged with 'using a vehicle which was not in good and serviceable condition' and 'driving without carrying white front lamps'.

     The defendant was convicted today and sentenced for imprisonment and fine.    

     Police appeal to the public that any person who uses a vehicle without the consent of the owner is liable to a maximum penalty of seven-year imprisonment. In addition, any person who uses a vehicle without a hire car permit for the carriage of passengers for hire or reward commits the offences of "Driving a vehicle for the carriage of passengers for hire or reward" and "Using a motor vehicle without third party insurance".  Committing the offence of "Driving a vehicle for the carriage of passengers for hire or reward" is liable to a maximum fine of $10,000, 12-month imprisonment and driving license be revoked for more than three years. Committing the offence of "Using a motor vehicle without third party insurance" is subject to a maximum penalty of $10,000 fine and six-month imprisonment.  

     If a member of the public rides on a vehicle without a hire car permit and pays the fare to the driver, he/she may not be covered by insurance after the accident.
