Company and man fined for illegal club operations

     A company and a man were fined $6,000 each at the Kowloon City Magistrates' Court today (February 8) for contravening the Clubs (Safety of Premises) Ordinance.

     The court heard that the Office of the Licensing Authority (OLA) of the Home Affairs Department conducted an inspection in August last year on a club in Hart Avenue, Tsim Sha Tsui, which has been operating with a certificate of compliance (CoC). During the investigation, OLA officers posed as customers and patronised the club for food and drinks without being asked to show their membership status or being invited to join the club. Furthermore, the exit route at the club was blocked. Conditions 9 and 19 of the CoC were breached.

     The company, being the CoC holder, was charged with contravening section 21(2) of the Ordinance.

     The OLA officers also conducted an inspection in August last year on a club in Minden Avenue, Tsim Sha Tsui, which has been operating with a CoC. During the investigation, OLA officers posed as customers and patronised the club for food and drinks without being asked to show their membership status or being invited to join the club. Moreover, the actual layout of the club was found to have deviated from the registered drawing. Conditions 3 and 19 of the CoC were breached.

     The man, being the CoC holder, was charged with contravening section 21(2) of the Ordinance.

     A spokesman for the department said enforcement action would continue to be taken against illegal club operations.
