Appointed examiner given suspended jail sentence and fined for making false statement

     An appointed examiner was sentenced at the Shatin Magistrates' Courts today (December 15) to two months' jail, suspended for 18 months, and fined $5,000 for violation of the Boilers and Pressure Vessels Ordinance. The prosecution was launched by the Labour Department.

     The case involved an inspection of a steam receiver by inspectors of the Boilers and Pressure Vessels Division of the Labour Department, which discovered that, in the certificate of fitness of the steam receiver dated March 6, 2011, the said appointed examiner made a false statement that the safety valve had been set or otherwise adjusted.  

     According to Section 55(1)(b) of the Boilers and Pressure Vessels Ordinance, any person who makes a false statement or entry in a certificate of fitness or in any such document is liable to a fine of $10,000 and to imprisonment for 12 months.
