Proprietor fined for violation of safety rules

     Lee's Mechanical Engineering Company Limited was fined $100,000 at Fanling Magistrates' Court today (September 27) for violation of the Factories and Industrial Undertakings Ordinance. The prosecution was launched by the Labour Department.

     The case involved an accident that occurred on February 23 this year at a container depot in Sheung Shui in which a worker was fatally injured by the wheel of a reach stacker during its dismantling.  

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risk to the health of the persons employed. Any proprietor who fails to do so is liable to a fine of $500,000.

     According to Section 6A(2)(c) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide such information, instruction, training and supervision as necessary to ensure the health and safety at work of the employees. Any proprietor who fails to do so is liable to a fine of $500,000.
