Contractors fined for violation of safety rules

     Chevalier (HK) Limited and Glorious (H.K.) International Limited were fined $25,000 and $42,000 respectively at the Kwun Tong Magistrates' Court today (July 7) for violating the Construction Sites (Safety) Regulations and the Factories and Industrial Undertakings Ordinance. The prosecutions were launched by the Labour Department.

     The case involved a fatal accident that occurred in Kwun Tong on December 23 last year, in which a worker was suspected to have fallen from an unprotected lift door opening on the 14th floor to the bottom of the lift shaft while erecting formwork for the lift door sill, and met his death.

     According to Regulations 38B(1) and 38B(1A) of the Construction Sites (Safety) Regulations, the contractors shall take adequate steps to prevent a person from falling from a height of two metres or more. Any contractor who fails to do so is liable to a fine of $200,000.

     According to Sections 6A(1) and 6A(2)(c) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide such supervision as necessary to ensure the health and safety at work of the employees. Any proprietor who fails to do so is liable to a fine of $500,000.
