Two officers and one employer fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Two officers and one employer were fined a total of $37,500 at the Kwun Tong Magistracy today (April 15) after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (the "Ordinance").

     Yum Siu Wah, an officer of Nail Salon Limited (BR No.: 39171476), was charged with an offence under sections 7(1) and 44 of the Ordinance. The defendant pleaded guilty to one count of failing to enrol one employee in an MPF scheme as required by the Ordinance. The defendant was fined $1,500 for the summons.

     Yum Siu Wah was also charged with offences under sections 7AA(7) and 44 of the Ordinance. The defendant pleaded guilty to four counts of failing to make MPF contributions to the MPFA for one employee who was not member of a registered scheme within the prescribed time for the contribution periods from July to October 2009. The defendant was fined $1,500 for each summons, totalling $6,000.

     Edith Wong Ho Wai, another officer of Nail Salon Limited, was charged with an offence under sections 7(1) and 44 of the Ordinance. The defendant pleaded guilty to one count of failing to enrol one employee in an MPF scheme as required by the Ordinance. The defendant was fined $1,500 for the summons.

     Edith Wong Ho Wai was also charged with an offence under sections 7AA(7) and 44 of the Ordinance. The defendant pleaded guilty to one count of failing to make an MPF contribution to the MPFA for one employee who was not member of a registered scheme within the prescribed time for the contribution period of July 2009. The defendant was fined $1,500 for the summons.

     Nail Salon Limited was charged with an offence under section 7(1) of the Ordinance. The defendant pleaded guilty to one count of failing to enrol one employee in an MPF scheme as required by the Ordinance. The defendant was fined $3,000 for the summons.

     Nail Salon Limited was also charged with an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to eight counts of failing to make MPF contributions to the MPFA for one employee who was not member of a registered scheme within the prescribed time for the contribution periods from June 2009 to January 2010. The defendant was fined $3,000 for each summons, totalling $24,000.
