Employer fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     An employer was fined $42,000 at the Kwun Tong Magistracy today (February 21) after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (the "Ordinance").

     Chau Lin Yiu trading as BC Company (BR no 35798024) was charged with an offence under section 7(1) of the Ordinance. The defendant pleaded guilty to a count of failing to enrol an employee in an MPF scheme as required by the Ordinance and was fined $6,000 for the summons.

     Chau Lin Yiu trading as BC Company, was also charged with an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to 12 counts of failing to make MPF contributions to the MPFA for an employee who was not a member of a registered scheme within the prescribed time for the contribution periods from November 2008 to October 2009. The defendant was fined $3,000 for each summons, totalling $36,000.

     Separately, the MPFA today obtained three orders for payment of outstanding MPF contributions of about $313,000 against three employers at the District Court.

     The three employers were Harbour Earth Development Limited, Cheong Lee Machinery Engineering Co., Limited and Woo Lam Cheong Esmond formerly trading as Anypoint Image. They were ordered to pay the MPFA the sums of $155,535.97, $100,154.15 and $57,628.08 respectively, being mandatory contributions in arrears and surcharges payable to one, 38 and three employees of the respective defendants.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court further ordered the defendants to each pay $930 as the costs of the claims.
