Contractors fined for violation of safety rules

     Sanfield Building Contractors Limited, Well Achieve Construction Company Limited and Wang Wai Construction Works Limited were fined $936,000, $96,000 and $376,000 respectively at Kwun Tong Magistrates' Court today (November 11) for violation of the Factories and Industrial Undertakings Ordinance and the Construction Sites (Safety) Regulations. The prosecutions were launched by the Labour Department.

     The case involved a fatal accident occurred on September 13, 2009 on a construction site at West Kowloon.  Six workers working on a temporary platform erected inside a lift shaft fell to their deaths when the platform suddenly collapsed.

     According to Sections 6A(2)(a) and 13(1) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risk to the health of the persons employed. Any proprietor who fails to do so is liable to a maximum fine of $500,000.

     According to Sections 6A(2)(c) and 13(1) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide such information, instruction, training and supervision as is necessary to ensure, so far as is reasonably practicable, the health and safety at work of the persons employed. Any proprietor who fails to do so is liable to a maximum fine of $500,000.
