An officer and three employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     An officer and three employers were fined a total of $226,000 at the Kwun Tong Magistracy today (November 1), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (the Ordinance).

     Chan Yam Fai, an officer of Great Step Industrial Limited, trading as The Friar Tuck Bar & Restaurant, was charged for offences under sections 7(1) and 44 of the Ordinance and fined $6,000 for failing to enrol an employee in an MPF scheme as required by the Ordinance.

     Chan was also charged for offences under section 7AA(7) and 44 of the Ordinance. The defendant pleaded guilty to 13 counts of failing to make MPF contributions to the Mandatory Provident Fund Schemes Authority (MPFA) for an employee who was not a member of a registered scheme within the prescribed time for the contribution periods between February 2009 and February 2010. The defendant was fined $3,000 for each of the seven summonses and $4,000 for each of the remaining six summonses, totalling $45,000.

     Great Step Industrial Limited, trading as The Friar Tuck Bar & Restaurant, was charged for an offence under section 7(1) of the Ordinance for failing to enrol two employees in an MPF scheme as required by the Ordinance and was fined $6,000 for each summons, totalling $12,000.

     Great Step Industrial Limited, trading as The Friar Tuck Bar & Restaurant, was also charged for an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to 27 counts of failing to make MPF contributions to the MPFA for two employees who were not members of a registered scheme within the prescribed time for the contribution periods between November 2008 and February 2010. The defendant was fined $3,000 for each of the nine summonses and $4,000 for each of the remaining 18 summonses, totalling $99,000.

     Hung Tak Chun, trading as Pretty Beauty Centre, was charged for an offence under section 7(1) of the Ordinance for failing to enrol an employee in an MPF scheme as required by the Ordinance and was fined $6,000 for the summons.

     Hung Tak Chun, trading as Pretty Beauty Centre, was also charged for an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to 10 counts of failing to make MPF contributions to the MPFA for an employee who was not a member of a registered scheme within the prescribed time for the contribution periods between April 2009 and January 2010. The defendant was fined $3,000 for each of the three summonses and $4,000 for each of the remaining seven summonses, totalling $37,000.

     Eagle Vision Limited, trading as Sky, was charged for an offence under section 7(1) of the Ordinance for failing to enrol an employee in an MPF scheme as required by the Ordinance and was fined $6,000 for the summons.

     Eagle Vision Limited, trading as Sky, was also charged for an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions to the MPFA for an employee who was not a member of a registered scheme within the prescribed time for the contribution periods between July and November 2009. The defendant was fined $3,000 for each summons, totalling $15,000.
