The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
An officer and an employer were fined a total of $36,000 at the Kwun Tong Magistracy today (October 26), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.
Chan Kin-ngok, an officer of Lucky Dragon Boat Restaurant Limited trading as Luke Yuen Hotpot Seafood Restaurant, was charged for offences under sections 7A(8) and 44 of the ordinance and pleaded guilty to six counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between October 2009 and March 2010. The defendant was fined $3,000 for each summons, totalling $18,000.
Lucky Dragon Boat Restaurant Limited trading as Luke Yuen Hotpot Seafood Restaurant was also charged for an offence under section 7A(8) of the ordinance and pleaded guilty to six counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between October 2009 and March 2010. The defendant was fined $3,000 for each summons, totalling $18,000.
Separately, the Mandatory Provident Fund Schemes Authority (MPFA) today obtained two orders for payment of outstanding MPF contributions of about $150,000 against two employers in the District Court.
The two employers were Lucky Dragon Boat Restaurant Limited and C & C Luxury Limited. They were ordered to pay the MPFA $79,922.79 and $70,756.08 respectively, being mandatory contributions in arrears and surcharges payable to 34 and eight employees respectively of the defendants.
The MPFA also pursued a claim in the Small Claims Tribunal for about $22,000 on behalf of 17 employees, who were owed MPF contributions by their employer.
At the Tribunal's hearings today, the defendant, Chan Chi-shing trading as New Gas And Company, did not appear. In its absence, the Adjudicator ordered it to pay the MPFA $22,136.71, being mandatory contributions in arrears and surcharges payable.
The amounts awarded at both the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered each defendant to pay the costs of $930. The Tribunal ordered the defendant to pay $169 as the costs of the claims.
