Conviction of making false statements to claim MPF benefits

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     An Mandatory Provident Fund (MPF) scheme member was convicted today (October 12) and fined $4,000 at the Kwun Tong Magistracy for breaching section 43E(1) of the Mandatory Provident Fund Schemes Ordinance (the Ordinance) by making false and misleading statements in documents to an MPF trustee.

     According to the prosecution, Lam Kwok Leung, applied to the trustee on February 8, 2010 for early withdrawal of his MPF accrued benefits on the ground of permanent departure. Investigation by the Mandatory Provident Fund Schemes Authority (MPFA) found that the defendant had recklessly provided false and misleading statements in claiming that he had not previously claimed payment of accrued benefits on the ground of permanent departure on an earlier departure date.

     Meanwhile, three officers and five employers were fined a total of $348,000 at the Kwun Tong Magistracy today after being convicted of offences under the Ordinance.

     Lam Shun Fa, manager of Hoi Fai Resource Management Limited, was charged for an offence under section 43E(1) of the Ordinance for making false or misleading statement. The defendant pleaded guilty to 18 counts of misreporting the "relevant income" of an employee to a trustee. The defendant was fined $1,800 for each summons, totalling $32,400.

     Sun Shing Cleaning Services Limited was charged for an offence under section 43E(1) of the Ordinance for making false or misleading statement. The defendant pleaded guilty to 15 counts of misreporting the "relevant income" of an employee to a trustee. The defendant was fined $2,000 for each summons, totalling $30,000.

     Sun Shing Cleaning Services Limited was also charged for an offence under section 7A(8) of the Ordinance and pleaded guilty to 15 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between July 2008 and September 2009. The defendant was fined $2,000 for each of the first four summonses and $3,000 for each of the remaining 11 summonses, totalling $41,000.

     Fan Pui Yan, officer of General Cargo Logistic Limited, was charged for offences under sections 7A(8) and 44 of the Ordinance and pleaded guilty to 30 counts of failing to make MPF contributions for employees within the prescribed time for the contribution periods between March and October 2008. The defendant was fined $2,000 for each summons, totalling $60,000.

     General Cargo Logistic Limited was also charged for an offence under section 7A(8) of the Ordinance and pleaded guilty to 30 counts of failing to make MPF contributions for employees within the prescribed time for the contribution periods between March and October 2008. The defendant was fined $2,000 for each summons, totalling $60,000.

     Liu Siu Ping, officer of Green Vision Limited, was charged for offences under sections 7A(8) and 44 of the Ordinance and pleaded guilty to nine counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between June 2009 and February 2010. The defendant was fined $4,000 for each of the first six summonses and $3,000 for each of the remaining three summonses, totalling $33,000.

     Green Vision Limited was also charged for an offence under section 7A(8) of the Ordinance and pleaded guilty to nine counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between June 2009 and February 2010. The defendant was fined $4,000 for each of the first six summonses and $3,000 for each of the remaining three summonses, totalling $33,000.

     Elite Great Limited trading as Tai But Tung Shoe Company, was charged for an offence under section 7A(8) of the Ordinance and pleaded guilty to a count of failing to make MPF contributions for an employee within the prescribed time for the contribution periods in March 2010. The defendant was fined $4,000.

     Tsui Wai Chun trading as Hai Yi Putonghua Educational Centre was charged for an offence under section 7(1) of the Ordinance and fined $10,000 for the summons for failing to enrol an employee in an MPF scheme as required by the Ordinance.

     Tsui Wai Chun trading as Hai Yi Putonghua Educational Centre was also charged for an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to 15 counts of failing to make MPF contributions to the MPFA for an employee who was not a member of a registered scheme within the prescribed time for the contribution periods between November 2008 and January 2010. The defendant was fined $3,000 for each summons, totalling $45,000.
