Conviction of making false statements to claim MPF benefits

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Two Mandatory Provident Fund (MPF) scheme members were convicted today (October 5) and fined a total of $10,000 at the Kwun Tong Magistrates' Courts for breaching section 43E(1) of the Mandatory Provident Fund Schemes Ordinance (the "Ordinance") by making false and misleading statements in documents to MPF trustees.

     According to the prosecution, the defendant, Chiu David, applied to a trustee on February 22, 2010 and Lee Wing Yip twice applied to a trustee on July 7, 2009 and September 17, 2009 for early withdrawal of their MPF accrued benefits on the ground of permanent departure.

     Investigation by the Mandatory Provident Fund Schemes Authority (MPFA) found that both had recklessly provided false and misleading statements in claiming that they had not previously claimed payment of accrued benefits on the ground of permanent departure on an earlier departure date.

     Chiu David was fined $6,000 and Lee Wing Yip was fined $2,000 for each summons, totalling $4,000.

     Meanwhile, an officer and an employer were fined a total of $54,000 at the Kwun Tong Magistrates' Courts today after being convicted of offences under the Ordinance.

     Lam Siu Yu Philip, officer of Land Asia Property Consultant Limited, was charged for offences under sections 7A(8) and 44 of the Ordinance, pleading guilty to seven counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between September 2009 and March 2010. The defendant was fined $4,000 for each of the first six summonses and $3,000 for the remaining summons, totalling $27,000.

     Land Asia Property Consultant Limited was also charged for offences under section 7A(8) of the Ordinance, pleading guilty to seven counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between September 2009 and March 2010. The defendant was fined $4,000 for each of the first six summonses and $3,000 for the remaining summons, totalling $27,000.
