Contractors fined for violation of safety rules

     KKP Limited and a sub-contractor were each fined $57,000 at Tsuen Wan Magistrates' Court today (October 5) for violation of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations.  The prosecutions were launched by the Labour Department.

     The case involved a fatal accident on January 4 this year at a workplace in Tsuen Wan.  A worker operating a lifting appliance on a scaffold at the external wall of a building fell to his death when the lifting appliance suddenly collapsed.

     According to 4(c) of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations, the owner shall ensure the arrangements for fixing and anchoring the appliance are adequate to secure its safety.  Any owner who fails to do so is liable to a maximum fine of $200,000.

     In addition, according to 5(1) of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations, the owner shall ensure that the lifting appliance is not used unless it has been thoroughly examined by a competent examiner at least once in preceding 12 months, and a certificate in the approved form in which the competent examiner has made a statement to the effect that it is in safe working order has been obtained.  Any owner who fails to do so is liable to a maximum fine of $200,000.
