An officer and three employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority (MPFA):

     An officer and three employers were fined $138,000 at the Kwun Tong Magistracy today (September 30), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (the ¡§Ordinance¡¨).

     Pak Kai Kwong, Officer of G & H Holdings Limited (BR no.: 38493330), was charged under section 7A(8) and section 44 of the Ordinance, and pleaded guilty to 12 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between April 2009 and March 2010. The defendant was fined $3,000 for each of the first 10 summonses and $2,500 for each of the remaining two summonses, totalling $35,000.

     G & H Holdings Limited was also charged under section 7A(8) of the Ordinance, and pleaded guilty to 12 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between April 2009 and March 2010. The defendant was fined  $3,000 for each of the first 10 summonses and $2,500 for each of the remaining two summonses, totalling $35,000.

     Man Kwok Chuen trading as Carrier Motors Company (BR no.: 31775385), was charged under section 7A(8) of the Ordinance, and pleaded guilty to 18 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between May 2008 and October 2009. The defendant was fined $2,000 for each of the first six summonses, $4,000 for each of other 11 summonses and $3,000 for the remaining summons, totalling $59,000.

     In Touch Transportation Co. Limited (BR no.: 37380750) was charged for an offence under section 7(1) of the Ordinance and fined $6,000 for the summons for failing to enrol an employee in an MPF scheme as required by the Ordinance.
 
     In Touch Transportation Co. Limited was also charged for an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to a count of failing to make MPF contributions to the MPFA for the employee who was not a member of a registered scheme within the prescribed time in February 2010. The defendant was fined $3,000.
