Two employers ordered to pay MPF contributions

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (August 27) obtained an order for payment of outstanding MPF contributions of about $108,000 against an employer in the District Court. Meanwhile, the MPFA pursued a claim in the Small Claims Tribunal for some $6,500 on behalf of an employee, who was owed MPF contributions by his employer.

     The District Court today granted a judgement against 3333 Limited trading as Top Choice Seafood and Hotpot Restaurant. The defendant was ordered to pay the MPFA $108,935, being mandatory contributions in arrears and surcharges payable to 36 employees of the defendant.

     At the Tribunal's hearing today, the defendant, Silver Hero International Limited trading as I Lounge, did not appear. In its absence, the Adjudicator ordered it to pay the MPFA $6,541.85, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendant to pay costs of $930. The Tribunal ordered the defendant to pay $205 as the costs of the claim.

     Silver Hero International Limited had pleaded guilty previously at Kwun Tong Magistracy to four counts of failing to make MPF contributions on time for its relevant employee and was fined $8,000.
