Yield Earn Limited was fined $50,000 at Kwun Tong Magistrates' Court today (August 5) for violation of the Factories and Industrial Undertakings Ordinance and the Construction Sites (Safety) Regulations. The prosecutions were launched by the Labour Department.
The case involved a fatal accident on December 22 last year in a quarry at Sau Mau Ping. A worker fell to his death as the platform on which he was working collapsed while he was lifting the dismantled upper part of a storage bin.
According to Sections 6A(2)(a) and 13(1) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risks to health of the persons employed. Any proprietor who fails to do so is liable to a maximum fine of $500,000.
In addition, according to Regulation 38B(1) of the Construction Sites (Safety) Regulations, the contractor shall take adequate steps to prevent a person on site from falling from a height of two metres or more. Any contractor who fails to do so is liable to a maximum fine of $200,000.
