Ten employers ordered to pay MPF arrears

Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (May 25) obtained five orders for payment of outstanding MPF contributions at about $839,000 against five employers in the District Court. Meanwhile, the MPFA pursued five claims in the Small Claims Tribunal for some $122,000 on behalf of 10 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgments against five employers, namely Ming Kai Finishing Company Limited, Joyful Management & Security Co. Ltd, Asia Intelligence (HK) Limited, Luen Hop Eng Co, and Rhoda International Kindergarten. The defendants were ordered to pay the MPFA the sums of $390,765.71, $233,847.57, $80,658.83, $69,170.54 and $65,390.01, being mandatory contributions in arrears and surcharges payable to 53, 119, 152, 20 and two employees of the defendants respectively.

     Meanwhile, at the Tribunal's hearing today, the defendant Tri's Engineering Company Limited did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA the sum of $31,769.28, being mandatory contributions in arrears and surcharges payable.

     The other four defendants, namely Cheng Kwok-cheung trading as Jetone Engineering Company, Joyful Management & Security Co. Ltd, Chau Lin-yiu trading as B C Company, and Ocean Right Limited trading as Mei Ho Seafood Restaurant, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $45,022.12, $25,151.87, $19,030.65 and $1,920.79, being mandatory contributions in arrears and surcharges payable respectively.

     The amounts awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court also ordered the defendants to pay costs of $930. The Tribunal ordered the respective defendants to pay $126, $179, $90, $139 and $95 as the costs in respect of the claims.
