The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
A member of Mandatory Provident Fund (MPF) Scheme was today (March 2) fined $4,000 at the Kwun Tong Magistracy for breaching section 43E(1) of the Mandatory Provident Fund Schemes Ordinance (the Ordinance) by making false and misleading statement submitted in document to the approved MPF trustee.
The defendant, Chow Pat Tong was charged under Section 43E(1) of the ordinance and was fined $4,000.
The prosecution said the defendant applied to his trustee on June 24, 2009, for early withdrawal of his MPF accrued benefit on the ground of permanent departure. Investigation by the MPFA found that the defendant had recklessly provided a false and misleading statement in claiming that he had not previously claimed payment of accrued benefit on the ground of permanent departure on an earlier date.
A company officer and four employers were fined $69,500 at the Kwun Tong Magistracy today, for offences under the ordinance.
Lewis Ho Chi Ngon, Officer of Deschamps Catering Company Limited (BR no.: 20767678) was charged under sections 7A(8) and 44 of the ordinance. The defendant pleaded guilty to five counts of failing to make full MPF contributions for an employee within the prescribed time for the contribution periods between March and July 2009. The defendant was fined $4,000 each for the first four summonses, $3,000 for the remaining summons. The defendant was fined a total of $19,000.
Deschamps Catering Company Limited was also charged for an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to five counts of failing to make full MPF contributions for an employee within the prescribed time for the contribution periods between March and July 2009. The defendant was fined $4,000 each for the first four summonses, $3,000 for the remaining summons. The defendant was fined a total of $19,000.
Vastsky International Holdings Limited trading as Causeway Bay Spicy Crab (BR no.: 36532776) was charged under section 7(1) of the ordinance and was fined $6,000 for failing to enrol an employee in an MPF scheme.
Vastsky International Holdings Limited trading as Causeway Bay Spicy Crab was also charged under section 7AA(7) of the Ordinance. The defendant pleaded guilty to three counts of failing to make MPF contributions to the MPFA for an employee who was not a member of registered scheme within the prescribed time for the contribution periods between May and July 2009. The defendant was fined $3,000 each for the summonses. The defendant was fined a total of $9,000.
Sese Gift Product Limited (BR no.: 39657329) was charged under section 7(1) and was fined $3,000 for failing to enrol an employee in an MPF scheme.
Sese Gift Product Limited was also charged under section 7AA(7) of the Ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions to the MPFA for an employee who was not a member of registered scheme within the prescribed time for the contribution periods between January and May 2009. The defendant was fined $1,500 each for the summonses. The defendant was fined a total of $7,500.
Netshop Comapny Limited (BR no.: 35342164) was charged under section 7(1) and was fined $6,000 for failing to enrol an employee in an MPF scheme.
The MPFA today pursued a claim in the Small Claims Tribunal for about $3,000 on behalf of an employee, who was owed MPF contributions by his employer.
Many Transport Limited did not appear at the Tribunal's hearing today. In its absence, the Adjudicator ordered them to pay the MPFA $3,373.78, being mandatory contributions in arrears and surcharges payable.
The amount awarded will be reimbursed to the employee's MPF account as soon as it is received by the MPFA. The tribunal further ordered the defendant to pay costs of $155.
