Bowls International Limited, operating Fullgar Canteen, was fined $10,000 at the Kwun Tong Magistrates' Courts today (November 24) for dismissing an employee injured at work before the issue of a certificate of assessment by an Employees' Compensation (Ordinary Assessment) Board. The prosecution was taken out by the Labour Department.
The employee, working as a chef, sustained injuries to his face and right forearm in a work accident on November 3, 2008. The company then dismissed the above employee before the issuance of the certificate of assessment by an Employees' Compensation (Ordinary Assessment) Board.
Section 48 of the Employees' Compensation Ordinance (ECO) stipulates that an employer shall not, without the consent of the Commissioner for Labour, terminate the contract of employment of an employee who has suffered incapacity in circumstances which entitle him to compensation under the Ordinance before the issue of an assessment certificate by an Employees' Compensation (Ordinary Assessment) Board.
Employers contravening this provision are liable on conviction to a maximum fine of $100,000.
