Luk Pak Wing Engineering Limited was fined $20,000 at Kwun Tong Magistrates' Court today (November 4) for violation of the Factories and Industrial Undertakings Ordinance. The prosecution was launched by the Labour Department.
The case involved a fatal accident on October 31 last year on a construction site at Choi Wan Road. A worker who was assisting in the lifting of metal formwork, was found lying on the ground with head injuries. The worker subsequently died.
According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor must provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risks to health of the employees. Failure to do so could mean a fine of $500,000 and imprisonment for six months.
