Proprietor fined for violation of safety rule

     Hip Hing Construction Company Limited trading as Hip Hing ¡V Ngo Kee Joint Venture was fined $45,000 at Eastern Magistrates' Court today (October 8) and ordered to pay costs of $5,000 for violation of the Factories and Industrial Undertakings Ordinance.  The prosecution was launched by the Labour Department.

     The case involved a fatal accident on February 26 last year on a construction site at Wan Chai where a construction worker was fatally injured when hit by a splice plate that toppled while it was being installed.

     According to sections 6A(1), 6A(2)(a), 6A(3) and 13(1) of the Factories and Industrial Undertakings Ordinance, proprietors must provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risk to health of the people employed.  Any proprietor who fails to do so is liable to a fine of $500,000 and imprisonment for six months.
