MPF Scheme member convicted for making false statement for benefits

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     A member of Mandatory Provident Fund (MPF) Scheme was today (September 1)fined $7,000 at the Kwun Tong Magistracy for breaching section 43E(1) of the Mandatory Provident Fund Schemes Ordinance by making a false and misleading statement in a document submitted to the approved MPF trustee.

     The defendant, Mok Kam Wah was charged under Section 43E(1) of the ordinance.

     The court heard that the defendant applied to his trustee on February 10 for early withdrawal of his MPF accrued benefits on the grounds of permanent departure from Hong Kong. Investigation by the MPFA found that the defendant had made a false and misleading statement in claiming that he had not previously claimed payment of accrued benefits on the grounds of permanent departure on an earlier departure date.

     A company officer and five employers were fined $20,000 at the Kwun Tong Magistracy today, after being convicted of offences under the ordinance.

     Chan Sin Lai, Officer of Asiatex Enterprise Limited was charged  under section 7(1) and section 44 of the ordinance and was fined $2,000 for failing to enrol an employee in an MPF scheme as required by the ordinance.

     Asiatex Enterprise Limited was also fined $2,000 failing to enrol an employee in an MPF scheme as required under section 7(1) of the ordinance.

     Johnloong Development Limited pleaded guilty to an offence under section 7(1A)(b) of the ordinance and was fined $5,000 for failing to enrol an employee in an MPF scheme.

     Ip Chun Bong trading as River Hair And Face and Lau Kin Hing trading as New Art Kit Laundry & Dry Clean Co both pleaded guilty to an offence under section 7(1) of the ordinance and were each fined $4,000 for failing to enrol an employee in an MPF scheme.

     Wai Tat Trading & Transportation Company Limited pleaded guilty to an offence under section 7(1) of the ordinance and was fined $3,000 for failing to enrol an employee in an MPF scheme.

     The Mandatory Provident Fund Schemes Authority (MPFA) today also obtained four orders in the District Court against four employers for payment of outstanding MPF contributions at about $861,000.

     The court today issued judgments against Caeser Beauty Centre Limited, Welmode Fashion Limited, Mega Projects Construction Limited and Actax Limited trading as Abraham College. The defendants were ordered to pay the MPFA $614,292.92, $132,846, $83,905.47 and $29,973.76 respectively, being mandatory contributions in arrears and surcharges payable to 116, 11, 14 and 27 employees.

     The MPFA today pursued seven claims in the Small Claims Tribunal for about $72,000 on behalf of 15 employees, who were owed MPF contributions by their employers.

     Ng Sai Hung trading as Peking Medicine Co and The Jadeite Workshop Limited, did not dispute the amounts claimed and were ordered to pay the MPFA $15,857.50 and $15,194.48, being mandatory contributions in arrears and surcharges payable.

     The other five defendants, Cheng Ping Chuen And Cheng Chi Ho Danny trading as Tak Lok Fashion Factory, Tang TaT Worldwide Logistics & Express Limited, Alex Information Limited, Wong Yiu Chi And Wong Tsao Yi Joey formerly trading as Fullagar Laminating Company and Yeung Che Lun Allen trading as Spark Trans Development, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $28,217.70, $5,087.74, $3,720, $2,452.32 and $1,890, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to each pay costs of $930. The tribunal ordered the defendants to pay costs of $159, $135, $179, $89, $116, $129 and $99.
