Employer fined for wage, holiday and annual leave pay offences

     Pakco Security (HK) Limited was fined $115,500 at the Kowloon City Magistrates' Courts today (August 10) for wage, holiday and annual leave pay offences under the Employment Ordinance.  The prosecution was taken out by the Labour Department.

     The employer failed to pay wages to 13 employees within seven days after the expiry of the wage periods as required by the Employment Ordinance.

     The employer also failed to grant the statutory holiday of Ching Ming Festival to one of the employees.  The employer also failed to pay holiday pay of Christmas Day, the first day of January, Lunar New Year's Day, the second day of Lunar New Year and the third day of Lunar New Year as well as annual leave pay to the same employee in accordance with the Employment Ordinance.

     According to Section 23 of the Employment Ordinance, wages due upon expiry of the last day of the wage period shall be paid as soon as practicable but in any case not later than seven days thereafter.  Any employer who fails to do so wilfully and without reasonable excuse is liable to a maximum fine of $350,000 and to imprisonment for three years.

     Any employer who fails to comply with the requirements of Section 39, 40 or 41B of the Employment Ordinance regarding the granting of statutory holiday or the payment of statutory holiday pay or annual leave pay is liable to a maximum fine of $50,000 for each offence.
