Employer fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     An employer was fined $16,000 at the Kwun Tong Magistracy today (August 7), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Timmical Cleaning Service Limited was charged under section 43E(1) of the ordinance for making false or misleading statement. The defendant pleaded guilty to a count of misreporting the employment date of an employee to trustee and was fined $10,000.

     The defendant was also charged under section 7(1) of the ordinance and fined $6,000 for failing to enrol an employee in an MPF scheme.

     The MPFA today also pursued three claims in the Small Claims Tribunal for about $36,000 on behalf of 31 employees, who were owed MPF contributions by their employers.

     The defendants, The Spa By L & Y Beauty Trimming Limited, The Spa Management Limited and World Team Trading Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $23,096.85, $12,516.63 and $912.67, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the respective defendants to pay costs of $136, $168 and $86.
