Company fined for sacking employee injured at work

     Beauty Sky Holdings Limited, a company providing wedding planning services, was fined $10,000 at the Kwun Tong Magistrates' Courts today (July 21) for dismissing an employee injured at work before the issue of a certificate of assessment.  The prosecution was taken out by the Labour Department.

     On September 19, 2008, an employee working as a sales person sustained a back injury in a work accident.  The company dismissed the employee before a certificate of assessment was issued by an Employees' Compensation (Ordinary Assessment) Board.

     Section 48 of the Employees' Compensation Ordinance stipulates that an employer shall not, without the consent of the Commissioner for Labour, terminate the contract of employment of an employee who has suffered incapacity in circumstances which entitle him to compensation under the ordinance before the issue of an assessment certificate by an Employees' Compensation (Ordinary Assessment) Board.

     Employers contravening this provision are liable on conviction to a maximum fine of $100,000.
