Six employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (July 21) obtained two orders in the District Court against two employers for payment of outstanding MPF contributions at about $312,000. The MPFA also pursued four claims in the Small Claims Tribunal for about $85,000 on behalf of 14 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgments against Kosmo Living Management (HK) Limited and Chak Chun Ming formerly trading as Chak Ming Engineering Company. The defendants were ordered to pay the MPFA $245,982.43 and $66,701.32 respectively, being mandatory contributions in arrears and surcharges payable to 66 and 35 employees of the defendants.

     At the tribunal's hearing, Healing Hands Limited, Venezia Environmental Services Limited, Full Gain Industries Limited and L.C Development Company Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $32,550.23, $27,502.93, $20,790 and $4,829.08, being mandatory contributions in arrears and surcharges payable.

     The MPFA also pursued a claim against Full Gain Industries Limited for a $5,000 financial penalty for failing to make MPF contributions for employees. Since the defendant did not appear at today's hearing, the Adjudicator ordered it to pay the MPFA $5,000.

     The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to each to pay costs of $930. The tribunal ordered the respective defendants to pay costs of $140, $126, $126 and $135.
