Three employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Three employers were fined $11,000 at the Kwun Tong Magistracy today (July 6), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Stephen Finley trading as Finley & Co. was charged for an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to two counts of failing to make MPF contributions for its employee within the prescribed time for the contribution periods between January and February 2009. The defendant was fined $3,000 for each summons, totalling $6,000.

     Brighter Engineering Limited pleaded guilty to an offence under section 7(1) of the ordinance. The defendant was fined $3,000 for the summons for failing to enroll an employee in an MPF scheme as required by the ordinance.

     Extreme (Group) Technology Limited was charged for an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to two counts of failing to make MPF contributions for its employee within the prescribed time for the contribution periods between April and May 2008. The defendant was fined $1,000 for each summons, totalling $2,000.

     The Mandatory Provident Fund Schemes Authority (MPFA) today also obtained four orders for payment of outstanding MPF contributions of about $375,000 against four employers in the District Court.

     The District Court issued judgments against four employers, namely, Binary Consultants Limited, Chong Fat Food Products Limited, Rever Hairstyling Salons Limited and Top Dragon Manufacturing Company Limited. The defendants were ordered to pay the MPFA the sums of $114,555, $92,694, $90,240.06 and $77,487.99 respectively, being mandatory contributions in arrears and surcharges payable to three, five, six and nine employees of the defendants.

     Meanwhile, the MPFA today pursued one claim in the Small Claims Tribunal for some $40,000 on behalf of nine employees, who were owed MPF contributions by their employer.

     At the tribunal's hearing today, the defendant, Hoi On Security Company Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA the sum of $40,710.14, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the District Court and the Tribunal will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to pay costs of $930 each. The tribunal ordered the defendant to pay $395 as the cost of the claim.

     Hoi On Security Company Limited pleaded guilty previously at Kwun Tong Magistracy to a count of failing to enroll its employee in an MPF scheme as required by the ordinance and was fined $8,000.
