Amendment regulations on registration of electors gazetted

     The Electoral Affairs Commission (EAC) published in the Gazette today (July 3) three amendment regulations on the registration of electors.

     The three amendment regulations will amend the Electoral Affairs Commission (Registration of Electors) (Legislative Council Geographical Constituencies) (District Council Constituencies) Regulation, the Electoral Affairs Commission (Registration) (Electors for Legislative Council Functional Constituencies) (Voters for Election Committee Subsectors) (Members of Election Committee) Regulation, and the Electoral Affairs Commission (Registration of Electors) (Village Representative Election) Regulation.

     "Upon the enactment of the Voting by Imprisoned Persons Ordinance (VIPO) by the Legislative Council on June 24, amendments to these three EAC Regulations are required to tie them in with the provisions in the VIPO and to provide for the related practical arrangements," a spokesman for the Registration and Electoral Office said.

     The amendments will put in place the following practical arrangements:

(a) the Electoral Registration Officer (ERO) can make available for  inspection all types of omissions lists at an additional place, so as to facilitate the ERO to cater for requests for inspection from prisoners or persons held in custody;

(b) prisoners or persons held in custody can deliver a notice of objection or claim by post, instead of having to deliver the notice in person; and

(c) the ERO can enter an elector's record on the omissions lists without inquiring with him on his registered address, if the elector concerned is a prisoner registered to a "deemed" address as prescribed in the Legislative Council Ordinance (LCO) and has left the prison without reporting his new residential address to the ERO.

     Moreover, upon the amendments, the definition of "principal residential address" in the first two EAC Regulations mentioned above will tie in with the scope of addresses prescribed in the LCO, as already amended by the VIPO, for the registration of prisoners as electors.

     The amendment regulations will be tabled at the Legislative Council on July 8.
