Two company directors fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Two directors of a company were fined $40,000 at the Kwun Tong Magistrates' Courts today (May 26) after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Chan Chau Bun, director of Flame Construction Company Limited, pleaded guilty to offences under section 7A(8) and section 44 of the ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions for his employee within the prescribed time for the contribution periods between February and June 2008. The defendant was fined $4,000 for each summons, totalling $20,000.

     Yeung Kwai Leung, another director of Flame Construction Company Limited, pleaded guilty to offences under section 7A(8) and section 44 of the ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions for his employee within the prescribed time for the contribution periods between February and June 2008. The defendant was fined $4,000 for each summons, totalling $20,000.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today also pursued seven claims in the Small Claims Tribunal for some $130,000 on behalf of 23 employees, who were owed MPF contributions by their employers.

     At the tribunal's hearing today, the seven defendants, namely Tang Tat Worldwide Logistics & Express Limited, Expert Ease Limited trading as Evernice Paper Hot Stamping Manufacturing, Ascent Union Limited, Ask V International Beauty & Fitness Company Limited, Sanwa Japanese Foods (HK) Co., Limited, Main City Seafood Hot Pot Restaurant Limited and A Khorum Vanida formerly trading as Chi Choi Hair Salon, did not appear. In their absence, the adjudicator ordered them to pay the MPFA the sums of $45,943.82, $32,161, $30,487.09, $15,683.88, $5,701.39, $1,230.12 and $146.25, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal also ordered the respective defendants to pay $246, $165, $120, $106, $105, $76 and $150 as the costs in respect of the claims.
