Views sought on Bill by LegCo

The following is issued on behalf of the Legislative Council Secretariat:

     The Legislative Council now invites members of the public and interested parties to express their views on the Road Traffic (Driving-offence Points) (Amendment) Bill 2009.

     The Bill, gazetted on January 23, 2009 and tabled in the Legislative Council on February 4, 2009, seeks to:

(a) specify the manners in which a summons issued under the Road Traffic (Driving-offence Points) Ordinance (Cap. 375) is to be served;

(b) provide that a summons is deemed to have been served if it is served on a person by registered post on the person's address shown in the record of driving licences kept by the Commissioner for Transport (the Commissioner), even if it is returned undelivered to the person; and

(c) require the Commissioner to refuse to issue, reissue or renew the person's driving licence if the person fails to appear before the court after the summons has been served.

     A Bills Committee, chaired by Hon Miriam Lau Kin-yee, has been formed to study the Bill. Interested parties are invited to submit their views on the Bill to the Bills Committee and indicate whether they wish to make oral representations to the Bills Committee at the meeting to be held on April 24 (Friday), from 5pm to 7pm in Conference Room A of the Legislative Council Building. If the submission is available in both Chinese and English, please provide both versions and their softcopy.  Those who wish to attend the meeting on April 24 to make oral presentations are requested to complete and return the attached reply slip to the Clerk to the Bills Committee by April 17. In line with the usual practice, all submissions received will be made available to the media and the public unless parties concerned have advised otherwise.
