The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
The Mandatory Provident Fund Schemes Authority (MPFA) today (March 23) obtained one order for payment of outstanding MPF contributions at about $160,000 against an employer in the District Court. Meanwhile, the MPFA pursued 12 claims in the Small Claims Tribunal for some $230,000 on behalf of 54 employees, who were owed MPF contributions by their employers.
The District Court today issued judgment against one employer, Adrian Engineering Limited. The defendant was ordered to pay the MPFA the sum of $165,966.46, being mandatory contributions in arrears and surcharges payable to 18 employees of the defendant.
Meanwhile, at the Tribunal's hearing today, five defendants, namely 3-med Medical & Rehab., Company Limited, Design Station Decoration Limited, Yuet Loi Restaurant Co., Limited, Cheuk Wai Nor & Cheuk Sze Ling formerly trading as Tendy Slimming & Beauty, and Top Champion International Investments Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sum of $43,954.76, $27,300, $16,964.93, $7,421.25 and $2,926.62, being mandatory contributions in arrears and surcharges payable.
The other seven defendants, namely, Star Team Development Limited trading as Wall City, Wah Tai Farm Company Limited, Trade Speed Industrial Limited, Kam Yuen Choy Hing Electronics Limited, Silk & Satin Limited, Genufx Systems Limited and Wong Mei Kuen formerly trading as Chun Chun, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $49,985.05, $39,168.4, $30,112.02, $12,701.68, $1,472.5, $915 and $202.5, being mandatory contributions in arrears and surcharges payable.
The amounts awarded at both the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendant to pay costs of $930. The Tribunal ordered the respective defendants to pay $180, $196, $205, $200, $156, $176, $240, $206, $116, $80, $60 and 80 as the costs in respect of the claims.
Star Team Development Limited trading as Wall City pleaded guilty previously at Kwun Tong Magistracy to three counts of failing to make MPF contributions on time and was fined $14,000.
